The website aller.com.co (hereinafter “the Page”) is a marketplace created by ALLER, a handcrafted jewelry brand, where Users can access products marketed by ALLER. In this regard, and for the purposes of this document, “Users” shall refer to any natural or legal person who acquires the products marketed on the Page.

Acceptance

Through successful registration on the Page, it is understood that Users acknowledge and accept compliance with the obligations and conditions of use established in this document. Therefore, Users must carefully read these Terms and Conditions on each occasion they intend to use the Page. ALLER may modify these Terms and Conditions at any time, which will apply from the moment of their publication, following notice to the Users.

Capacity

The use of the Page is only permitted for natural or legal persons with the legal capacity to accept these Terms and Conditions.

Access to the Page

For the successful registration of natural person Users, the following data must be provided: i) Full name, ii) Type and number of identification, iii) Personal address, iv) Contact number, and v) Email address. For the successful registration of legal person Users, the following data must be provided: i) Corporate name, ii) NIT (Tax ID), iii) Principal domicile address, iv) Contact number, and v) Email address.

Users may not assign or be substituted by third parties in the exercise of the rights and commitments imposed upon them. To access the Page, Users must have the physical and technological means that allow them, via the Internet, to access the marketed products. Users shall acquire and maintain at their own cost and expense all equipment and communication means necessary to use the Page.

Obligations of the Users

Without prejudice to other obligations contained in these Terms and Conditions, Users agree to: a) Follow recommendations regarding the operation and security of Page access. b) Keep the software of the devices used to access the Page updated. c) Provide real, verifiable, and reliable information. d) Exercise the right of withdrawal (retracto) solely and exclusively under the terms of Law 1480 of 2011. e) Pay for products purchased on the Page through the provided payment channel or gateway. f) Refrain from copying, reproducing, extracting, using, printing, disclosing, or making use of ALLER's distinctive signs without prior express authorization from the owner.

Products

On the Page, Users may purchase products marketed directly by ALLER. To this end, once Users enter the Page, they must select the desired product and provide the following information: i) names, ii) type and number of identification, iii) contact number, iv) email address, v) personal delivery address, vi) product and quantity. Users must register their purchase and pay in full for the products through the provided payment channels or gateways. However, ALLER is not responsible for the channels, payment methods, or gateways; ALLER is only responsible for the delivery, warranty, and suitability of the products.

Delivery and Availability of Products

Product availability is subject to inventory. Aller ships throughout the national territory (Colombia) and internationally.

  • Processing Times: Once the purchase is confirmed, the order will be prepared within two (2) business days. Except in cases of force majeure, fortuitous events, or absence of production material, which will be immediately reported to the User via instant messaging.

  • Shipping Times: Estimated delivery time by the carrier is five (5) to ten (10) business days for national shipments. International times will vary depending on the destination country. Except in cases of force majeure or fortuitous events beyond the carrier's control.

  • Shipping Costs: A fixed freight rate will apply for all shipments within Colombia. International shipments will be quoted based on the destination. The final price will be informed on the Page prior to payment.

  • Loss: In case of package loss by the carrier, Aller will assume responsibility and cost, guaranteeing the shipment of a new product or a refund.

  • Open/Damaged Package: If the User receives a package with signs of being opened or tampered with, they must not accept it and must leave a note on the carrier's guide, reporting it immediately to the official email. If the User accepts a visibly open package, responsibility for the state of the pieces will fall upon them.

Warranties

Aller responds under the terms established by law for the quality, suitability, safety, and good condition of the products.

  • Warranty Validity: The warranty is for two (2) months, starting from the moment the product is received.

  • Coverage: It exclusively covers manufacturing defects (faults in soldering, clasps, or stones falling out due to setting defects) not detected in our pre-shipment quality inspection. The customer must notify the defect within the first five (5) calendar days following receipt.

  • Procedure: The User must send an email to [email protected] including their full name, identification type and number, order number, and clear photos of the product's condition or reported damage. A response will be provided within the next 5 business days.

    • If applicable, ALLER will arrange for the carrier to collect the product, which will later be sent back at no cost to the User. Except if the claim is for a change in product color, in which case the User must bear the collection and reshipping costs.

    • ALLER will evaluate the appropriateness of repairing the product and will inform the User via email or instant messaging within 5 business days after the product arrives at the workshop.

    • If repair is not possible, it will be replaced with an identical model. If the model is out of stock, the customer may choose another piece of equal or lesser value. If a higher-valued piece is chosen, the difference must be paid. Shipping costs for these cases will be covered by ALLER.

Warranty Exclusions:

  • Chain breakage due to pulling or improper handling.

  • Stone breakage due to impacts or drops.

  • Natural darkening of 925 silver (normal oxidation process).

  • Loss of parts or components of the jewelry.

  • Color changes or peeling of the gold plating on bronze pieces due to misuse (contact with chemicals, sweat, perfumes) or natural friction after the 2-month warranty.

  • Products on discount or sale: No exchange or return options.

  • Expiration of the warranty period.

  • Previous repairs or modifications by personnel not authorized by ALLER.

Right of Withdrawal and Exchanges

According to Law 1480 of 2011, the User has five (5) business days after receiving the product to request a refund. The product must be returned in its original packaging.

  • Exchanges: If the User wishes to exchange the piece for reasons unrelated to quality, they must assume the total cost of return and reshipping freight.

  • Refunds: Money will be reimbursed directly to the User after sending a bank certification proving ownership of the payment method. The refund will be processed within a term of up to 30 calendar days.

Product Care

To prolong the life of your jewelry, follow these recommendations:

  • 24Kt Gold Plated Bronze: Do not get wet. Avoid contact with perfumes, lotions, creams, chlorine, or excessive sweat.

  • 925 Silver: Although it is water-resistant, it is recommended to avoid contact with chemicals to prevent premature oxidation.

  • Storage: Store each piece individually in its original packaging to avoid scratches and friction with other metals.

  • Every product includes a physical card with these specifications; failure to follow them voids the warranty due to misuse.

Page Service

ALLER will strive to ensure that access to the Page is available to Users twenty-four (24) hours a day, every day, without prejudice to specific operational limitations or device/connection restrictions. Therefore, ALLER does not guarantee uninterrupted access. ALLER reserves the right to interrupt or suspend access for technical, security, connectivity, or force majeure reasons. ALLER may deny services if Users misuse the Page or act against Information Security policies.

Property Rights

The Page may use its own technological platform or that of a designated third party. Users expressly authorize such third parties to handle the information necessary for the execution of the service. All software and code used on the page are the property of ALLER and/or its providers and are protected by intellectual property laws.

All information provided by ALLER, as well as brands, logos, domain names, inventions, patents, goodwill, designs, trade secrets, copyright, and know-how, remain its exclusive property. Users must refrain from publishing, retransmitting, or commercializing the content of the Page.

Payment

Users accept that the only currencies for payment are the Colombian Peso (legal tender) and the US Dollar.

Liability

ALLER shall not be liable unless attributable responsibility is proven, including but not limited to: a) Force majeure or third-party acts. b) Technical problems or maintenance. c) Information on external websites linked to the Page. d) Failures in User equipment or networks. e) Misuse of the Page by Users. f) Cyberattacks or viruses.

Applicable Law and Jurisdiction

These policies and conditions are governed by Colombian Law and are subject to Colombian judges and courts.
